The new norm established by the FDA, within the framework of the Bioterrorism Act of 2002, seeks to protect consumers of potential terrorist attacks or any threat that could be penetrated against the food provision of the United States; within the norm the registration becomes obligatory for companies like SAAM S.A.
In order to carry out the new dispositions of the Bioterrorism Law, the FDA published the past October an interim final regulation, Registration of Foods Facilities, which requires domestic and foreign facilities that manufacture/ process, pack, or hold human or animal consumption in the United States to register. Under this new exigencies and understanding that SAAM participates in the exporting chain, the company registered its facilities and warehouses the past November 28th, 2003.
It is possible to emphasize that those facilities, that do not fulfill the new requirements, for instance if the registry is required, and it has not been carried out satisfactory, food from that foreign facility that is offered for import into the U.S. is subject to be detained within the port of entry, unless otherwise directed by the FDA or the Bureau of Customs and Border Protection (CBP).
